EB-5 Industry Leaders, USCIS Agree to Joint Settlement of Two Lawsuits

EB-5 stakeholders ensure all previously approved regional centers maintain authorization moving forward

WASHINGTON, D.C., Aug. 25, 2022 (GLOBE NEWSWIRE) — Multiple EB-5 industry stakeholders have entered into a settlement agreement with the United States Citizenship and Immigration Services (“USCIS”) that protects EB-5 investors and re-authorizes previously approved regional centers, effectively signaling the EB-5 program is fully back in business.

The settlement affects two cases: Behring Regional Center LLC, et al. v. Mayorkas, et al., No. 3:22-cv-2487-VC (N.D. Cal.) and EB5 Capital, et al. v. DHS, et al., No. 3:22-cv-3948-VC (N.D. Cal.). The plaintiffs include EB-5 regional center operators: EB5 Capital, CanAm Enterprises, Civitas Capital Group, Golden Gate Global, Pine State Regional Center, and EB-5IC’s member – Behring Regional Center, and industry organization Invest in the USA (“IIUSA”).

The key stipulations of the settlement – which can be read in its entirety here – are as follows:

  • Previously authorized regional centers retain their authorization.
  • Previously authorized regional centers must file a Form I-956 (a previously filed I-956 will meet this requirement) by December 29, 2022, along with the filing fee to maintain authorization.
  • Previously authorized regional centers need not wait for approval of their Form I-956 and may immediately file I-956Fs (exemplars).
  • If, after filing a form I-956F, a regional center does not receive a formal receipt notice within ten calendar days of delivery to USCIS, an investor may use other forms of proof of the I-956F filing in their I-526E petition, such as a lock box receipt, cashed check, or credit card charge provided by the regional center to the investor.
  • The failure of a previously approved regional center to file a Form I-956 application or amendment will not, standing alone, be a basis for USCIS to deny an investor’s I-526 or I-829 petition.
  • USCIS will update its website, forms, and instructions to conform to the terms of the settlement agreement.

The settlement comes in the wake of legal action taken to protect the EB-5 industry from USCIS’ decision earlier this year. After the EB-5 Reform and Integrity Act of 2022 went into effect in March, USCIS announced that all previously approved regional centers (those authorized by USCIS before the enactment of the Integrity Act) were categorically deauthorized. The Court determined that USCIS’ action almost certainly committed legal error and would have severely harmed the EB-5 industry while leaving EB-5 investors in limbo. While all parties involved have agreed to the settlement, it is not a final settlement until approved by the court.

Doctors at Manipal Hospitals, Dwarka give new lease of life to a 30-day-old newborn suffering from brain tumor

NEW DELHI and KHARTOUM, Sudan, Aug. 25, 2022 /PRNewswire/ — Doctors at Manipal Hospitals, Delhi successfully saved the life of a 30-day-old newborn baby with a brain tumor. The baby was presented at the hospital in an emergency with a complaint of seizures and unconsciousness. Upon further diagnosis, a CT scan found a severe brain hemorrhage along with a tumor causing significant pressure inside the brain. The baby’s blood tests were also hampered by extremely high INR levels, indicating hemolytic disease. The baby’s weight was just 3 kg, which is why putting him on anesthesia was a great challenge. Even minimal blood loss during the surgery would have put his life at risk. After stabilizing him medically and post a detailed discussion with his family regarding the need for the surgery and the risks involved, the surgery was performed. While performing the surgery, extreme precautions were taken, keeping in mind that the skull at this age is exceptionally soft and any undue pressure can cause increased pressure on the brain along with the risk of vision loss. Throughout the surgical procedure, the anesthesiologist made sure that the baby was stable.

UVAS arranged 1st workshop on the “Impact of Interpretations of Hematological Investigations for Disease Diagnosis”

Lahore, August 25, 2022 (PPI-OT):The Department of Pathology of the University of Veterinary and Animal Sciences Lahore arranged 1 st workshop on the “Impact of Interpretations of Hematological Investigations for Disease Diagnosis” here at City Campus on Thursday.

Vice-Chancellor Prof Dr Nasim Ahmad presided over the concluding session and distributed certificates among participants while Chairman Department of Parasitology Prof Dr Kamran Ashraf chaired inaugural session of the workshop.

Chairman Department of Pathology Prof Dr Asim Aslam, Dr Gulbeena Saleem, Dr Qamar-un-Nisa and a number of faculty members, postgraduate students and veterinarians/professionals from public and private sectors were present on the occasion.

While addressing the audiences, Prof Dr Nasim Ahmad said that such workshops are very necessary for learning each other experiences and knowledge especially for providing disease diagnostic facilities to livestock farming community and journal public. He also mentioned hundreds of large and small animal treatment cases dealing at UVAS clinics on daily basis.

He lauded the organizer to arrange this workshop on informative topic and urged them to add practical session to imparting practical knowledge for professional training. Earlier Prof Dr Kamran Ashraf said that it is an informative workshop especially for the advancement of disease diagnosis of human and animals through Hematological Investigations.

He said workshop will provide opportunities of learning to the participants regarding innovative knowledge and Hematological Investigations techniques. Dr Gulbeena Saleem spoke about the objectives of the workshop.

The objectives of the workshop were to equip the postgraduate students, young faculty and field veterinarians from public and private sector to formulate/contribute to a correctly prioritize relevant diagnosis including based on hematological investigations, improving the diagnostic approaches, pragmatic approaches to challenges in disease diagnosis and human resource development.

Various aspects have been discussed during workshop related to hematology and its interpretation in bovine, clinical interpretation of CBC test in general practices, significance of hematological investigation in diagnosis of infectious anemia and the magic of interpreting hematology histograms etc.

Islamabad, August 25, 2022 (PPI-OT):Federal Minister for Poverty Alleviation and Social Saftey and the Chairperson of Benazir Income Support Program, Shazia Atta Marri has said that recent heavy monsoon rains and flash flooding has caused severe devastation and losses of life in Pakistan and adding that provinces of Sindh, Balochistan and South Punjab have received more rains which caused widespread damages while the people are suffering from severe problems.

She said that the government is taking effective measures for the rehabilitation, relief and rescue of the rain and flood effected peoples and vowed that no one would be deprived of Benazir Income Support Program’s financial assistance while Chairman PPP Bilawal Bhutto Zardari has been monitoring the whole situation arising after monsoon rains in province.

Shazia Marri uttered that government is trying best to reach the flood and rain affectees to provide them relief and added that the agriculture sector of Sindh and Balochistan provinces has also been completely destroyed due to havoc of recent rains.

She said that Pakistan is currently facing a devastating tsunami and this is not the time for political point scoring but to serve the rain and flood effected peoples because after the ravages of rains, the people are crying for assistance and help while the situation is very critical in the rain-hit areas.

CM Ch Parvez Elahi announces allocation of 5 billion rupees and “CM Punjab Flood Relief Fund” for rehabilitation of flood victims 

Lahore, August 25, 2022 (PPI-OT):Chief Minister Punjab Chaudhry Parvez Elahi has announced allocating five billion rupees for the early rehabilitation of the flood victims of south Punjab besides setting up the “Chief Minister Punjab Flood Relief Fund” for their resettlement.

He stated this while talking to various parliamentarians including Ghazanfar Abbas Chhina, Shahabuddin Khan, Muhammad Amir Inayat Shahani, Ghazanfar Abbas Shah, Ghulam Ali Asghar Khan Lehri, Gulraiz Afzal Gondal, Taimur Ali Lali, Sardar Muhammad Mohyuddin Khan Khosa, and Muhammad Ali Raza Khan Khakwani.

Speaking on this occasion, the CM said that the entire machinery of the Punjab government was busy helping the flood affectees.

On my instructions, Chief Secretary Kamran Afzal was also monitoring the rescue and relief operations in the affected areas; he mentioned and grieved over the loss of life and property in Taunsa, DG Khan and Rajanpur areas. The government would arrange every available resource and philanthropists should also come forward to help the people in need, he said.

It is not possible to describe the catastrophe in words; he added and vowed to do whatever is humanly possible. ‘I have ordered a survey to rectify the damages as rehabilitation of flood victims is a governmental priority, ‘he said.

The Punjab government stands with the victims in their time of need and would not sit idle till the complete resettlement of the victims is not done, the CM added. Everyone affected by the flood would be given their right and we will come out of this challenge; he reiterated and appreciated the cooperation of the Pakistan Army in relief activities.

Pakistan Army is a proud institution which also takes the lead in helping people in emergencies. Army jawans have participated in relief activities along with civil administration; he mentioned and noted that be it an earthquake, flood or any other sudden calamity, Pakistan Army has always come up to the expectations of the nation in every hour of trial.

They have extended timely help to ensure safe evacuations and I am thankful to Corps Commander Multan as numerous lives were saved due to the support of the Pakistan Army, the CM concluded.
